Shelby & San Augustine County clerks say they will issue same-sex marriage licenses

Texas Attorney General Ken Paxton calls the Supreme Court decision giving same-sex couples the right to marry a "lawless ruling" and says state workers can cite their religious objections in denying marriage licenses.

 

He warned in a statement Sunday that any clerk, justice of the peace or other administrator who declines to issue a license to a same-sex couple could face litigation or a fine. But he says "numerous lawyers" stand ready to defend, free of charge, any public official refusing to grant one.

 

In Shelby County County Clerk Jennifer Fountain told Center Broadcasting that she had conferred with Assistant District Attorney Stephen Shires and County Attorney Gary Rholes and they both told her to avoid any legal implications, both personally and against the county, to go ahead and proceed with issuing licenses.

 

Ms. Fountain said she took an oath to uphold the law of the office, the county and state of Texas and she would abide.

 

She noted she’s waiting to receive the forms electronically from the vendor.

 

Meanwhile, San Augustine County Clerk Margo Noble said she now has the proper forms and will be issuing licenses.

 

As of lunch Monday, neither Shelby nor San Augustine County had had a same-sex couple approach their offices for a marriage license.

 

Not all east Texas counties are issuing same-sex marriage licenses. Those include Sabine and Panola Counties.
