Commissioners again table resuming maintenance on roadway, agree to rent old elementary gym

Shelby County Commissioners have again tabled taking action on resuming maintenance on a portion of County Road 4670 as a property owner is seeking designation so that his property can be sold, legally.
 
Don & Tina McGuffin say the title company will not recognize it since there's no legal access because the roadway is not a county road and 9-1-1 mapped.
 
The road has been maintained by a property owner previously without county help, the court is just hesitant to take action at this time, and is hoping the adjoing landowners to the road can work out some details to allow the McGuffin's full clearance.
 
McGuffin was unsure why commissioners would not designated the roadway, since he's not asking for maintenance.
 
If an agreement cannot be reached between the McGuffin's and neighboring property owners the issue could possibly wind up in a courtroom. 
 
Shelby County Commissioners also agreed to rent the old elementary school gym on Nacogdoches Street to Denetra Slaughter and Celia Aguilar so their Zumba exercise classes could continue.
 
County Attorney Gary Rholes will work out a rental agreement for $300 a month, to include electricity and include a liability exclusion. The ladies said their workout classes are popular in the community and they're definitely not holding them to make a profit. 
 
County Judge Allison Harbison said Tri-County Community Action has been using the gym for meetings, but the new rental agreement will limit use to Ms. Slaughter and Ms. Agular.
 
The ladies had sub-leased the facility from another individual until that agreement expired last month.
 
The court also signed resolutions for the 2016 TxDOT Bridge replacement construction project that includes six county-road bridges.
 
Nancy Smith with Lufkin District TxDOT was in attendance and said the project falls in Fiscal Year 2016.
 
The bridges slated for replacment include: CR 3564 Hilliard Creek, CR 3455 Spinney Creek, CR 3455 Shoat Creek, CR 4256 Tributary of Flat Fork Creek, CR 4916 Flat Fork Creek and CR 4670 McFaddin Creek.
 
Ms. Smith said TxDOT prefers to close the roadway where the replacement is being done instead of seeing the county pay for right-of-way and utility acquisition.
 
In an unrelated bridge project, Ms. Smith advised the replacement of the Bear Creek Bridge on FM 415 in the Silas Community will be done without having to close the road to thru traffic. She said a road to the side will be constructed, and work should begin next Spring or Summer.
