Judge agrees to reduce Hudson's jail sentence, court papers say business is "failing"

The Daily Sentinel in Nacogdoches is reporting that a Nacogdoches County judge on Wednesday agreed to reduce the six-month jail sentence he ordered a business owner and Center native to serve in February after he reportedly violated the terms of his deferred probation. The article says that in his motion to serve the remainder of his sentence on weekends, Willie Hudson’s attorney, Stephen Shires, argued that:

The defendant has served 122 days, including the time he previously spent in the Nacogdoches County jail awaiting his hearing.

Hudson has not been inside his store, Nacogdoches Hardware & Rental, since 2014.

Nacogdoches Hardware & Rental is in “financial straits.”

The business will likely fail if Hudson does not return.

The newspaper article says a spokesperson for Shires’ law firm in Center said Hudson’s sentence was reduced from 180 days to 130 days.

On Feb. 11, in addition to jail time, Judge Ed Klein sentenced Hudson to “intensive supervision” following his release. He also extended his deferred probation for two years.

In October 2014, 60-year old Hudson pleaded guilty to unlawful restraint in Klein’s court — six days after he appeared in the same court for a pretrial hearing, when his indictment for robbery and injury to a disabled individual was amended to include unlawful restraint. Those counts were dismissed.

In the plea agreement, Klein ordered Hudson to pay a $1,000 fine and perform 250 hours of community service. And all of his conditions of bond set by Klein in August were included.
