Judge recesses gross prosecutorial misconduct hearing until Dec. 8

A hearing concerning gross prosecutorial misconduct in a case involving a Center woman accused of stabbing a Nacogdoches man to death two years ago has been recessed until Dec. 8.

 

District Judge Charles “Brick” Dickerson is requesting a subpoena of an email from District Attorney Kenneth Florence to a local newspaper before moving forward.

 

Since the 2014 incident in which 34-year old Rebecca Fountain is accused of killing Mark Allen Ray, she’s had two court-appointed attorneys. The latest, Robert Goodwin filed several motions to remove himself after a reported altercation with DA Florence in the courtroom last month. Florence has recused himself from the case.

 

Fountain’s murder trial is set to start in April 2015.
