Timpson mayor's federal lawsuit to have evidentiary hearing Sept. 26

An evidentiary hearing has been set for later this month in the Federal lawsuit against Timpson Mayor Debra Smith.

She was named in the suit filed by Councilman George Grace earlier this summer claiming voter discrepancies.

Grace was defeated by Ms. Smith in May's mayoral election, and he's seeking $1,800 in campaign expenses, and was asking for free legal representation, which has been denied.

Grace alleges in the lawsuit there were seven voters in the election that were not legal to cast ballots.

Ms. Smith defeated Grace, 128 to 64.

The evidentiary hearing is set for 10:30 a.m., Friday, Sept. 26 at the U.S. Courthouse in Lufkin.
